My opinion is that the credit union should have at least waited until after the funeral...out of respect if nothing else.

I am totally confused at what respect has to do with a financial organization filing paperwork for a delinquent loan?
You want to talk about respect? I recently helped with the funeral arrangements for a family member. There is no respect in the financial end of that. Just a few highlights.... $350 for the obit in the Courier (only appeared one day); $2000 for the burial plot and then another $250 to dig the hole; $100 to have a balding man's hair "styled"... the list goes on. And did I mention that we were advised that 100% payment needed to be made prior to visitation. Fortunately we had the financial means to cover everything, but geeze!
I suspect this payment in advance is the result of those who did not pay their bills.... same as those who don't pay their car loan bills.

I know this looks like a hijacking, but really, what respect does this woman deserve? And how does serving papers on her affect other members of the family?

The "respect" this woman deserves is the same as anyone who enters our justice system: the assumption that they are innocent in the eyes of the law until they are proven guilty. We can pass judgement from our living rooms about her guilt, but if the payments weren't behind, I don't think the credit union should be legally able to take the van back. The fact they petitioned the courts probably means the woman was current on payments, otherwise the credit union would be within their rights to just take it back without legal permission. For all we know, the vehicle might be considered evidence and nobody is getting it until after the trial.


I have to look at this from this perspective: If I were wrongfully arrested for something which everyone thought I was guilty of... would it be ok for my creditors to simply take my home, car or whatever based on their assumption I was going to be locked up for a long time? I still think the credit union saw an opportunity to seize an almost paid off vehicle and resell it. Would love to know what happened in all this.

excellent points, Canon. Obviously you are more well read on this than I am. I had assumed that it was already established that she was delinquent on payments. If that was not the case and the petition was in anticipation of her conviction, then definitely premature, probably wise as far as protecting their interests, but could have waited a bit. Still having a hard time with the "respect" part though....
I agree that innocent until proven guilty, but didn't she confess? Yes, I know, due process and all that but I get so frustrated with those who confess and then plea innocent. IMO, waste of the courts time, but that debate is for another thread.

I have no respect for anyone that kills their children. Regardless of what bs is going on they can't handle,you DO NOT kill your children. WRONG! WRONG! WRONG! Mad
