Some first hand knowledge:

The outbuilding in the story has been used as a tool shed not really a play house and the people where told several times to remove it. Soon the Court will tell them to move it and HOA will be sending them the attorney’s bill. Our covenants are very well written.

The Covenants where we live says that there are no outbuildings allowed. It should have occurred to you or anyone that an outbuilding no matter what you call it playhouse or shed that is not attached or part of your personal home is an outbuilding.

And it's highly unlikely that Dominion can retain the board for 30 years. The CC&Rs are generally written with them being in effect for that sort of time frame, but NOT the developer's control over the Association. As the developer, after a certain percentage of the homes are built then they have to turn it over to the homeowners to manage. It's generally specificied in the Association's By-laws. You can look them up online in most cases.

I would like to see the portion of the by-laws or CC&Rs that address that issue. What is the legal name of your Homeowners Association? It would not be Dominion, but whatever name they incorporated the Homeowners Association under.

Regarding PLAYHOUSES: why would you not think that an enclosed structure with a roof would not be a "building" (hence an "out" building if not attached to the main structure), regardless of its size?

MOST CC&Rs don't apply to the temporary portable playhouses that can be moved around on the property, the ones made of Fisher-Price-style plastic. But if it is a permanent structure, with a floor, walls, and a roof, then it is an "outbuilding."



I wasn't aware you were the King or Queen of everyones HOA. Apparently I do have a chip on my shoulder and since you've missed it TWICE,I'll say it again WITH DOMINION HOMES,NOT the HOA. Clear enough NOW?

You may need someone to help you read and understand the rules, if you think you can do what you want. Maybe you just need a good realtor and the directions to the closest trailer park.


You're reading and comprehension is not that good either I see. Durrrrrrrrr. Where have I said we should be able to do what we want? Foot taste good? Roll Eyes Roll Eyes I never asked anyone here about the rules as I have stated I have been in my HOA 5 years so I definately don't need some know-it-all who knows nothing to try and tell me anything.

If any of you home association's need a neighborhood communication tool so that everyone can be a part of the community and know what's going on and when, you might want to check out our community website at http://www.dogwoodhomeassoc.com
It seems to be working out for our neighborhood to know what's going on and help out with our blockwatch program.
If people know what's happening in their neighborhood's, they follow suit and begin to all fall in line with the rules of the community.
